By using Make Your Home Glow ("Service"), you agree to these Terms of Service ("Terms"). Please read them carefully before using our Service.

1. Service Description

Make Your Home Glow provides AI-powered photo enhancement services designed to improve the visual quality of property images. Our Service enhances existing photographs through adjustments to lighting, color balance, clarity, and other visual properties.

Our Service does NOT:

• Add objects, furniture, or items not present in the original photo
• Remove objects, furniture, or items from photographs
• Alter the physical layout or structure of spaces
• Misrepresent the actual condition or features of properties
• Generate entirely new images or composite photographs

All enhancements are limited to improving the presentation of what already exists in your photographs.

2. User Responsibilities

By using our Service, you represent and warrant that:

• You own or have proper authorization to use and modify the photographs you submit
• The photographs you submit accurately represent the property being listed
• You are solely responsible for ensuring your photos and listings comply with all applicable laws, regulations, and third-party platform policies
• You will review all enhanced photos before use and are solely responsible for their accuracy

Make Your Home Glow makes no guarantees regarding compliance with Airbnb, VRBO, or any other booking platform's policies or guidelines. You are solely responsible for ensuring your listings meet all platform requirements.

3. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MAKE YOUR HOME GLOW AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR:

• Any account suspensions, restrictions, or terminations on any booking platform
• Cancellations, refusals, or disputes with guests or booking platforms
• Lost bookings, lost revenue, or any other economic losses
• Indirect, incidental, special, consequential, or punitive damages of any kind
• Any claims arising from your use of enhanced photos

IN NO EVENT SHALL MAKE YOUR HOME GLOW'S TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID FOR THE SERVICE GIVING RISE TO THE CLAIM, WHICH SHALL NOT EXCEED $79 USD.

This limitation applies regardless of the legal theory upon which the claim is based, including contract, tort (including negligence), strict liability, or any other theory.

4. Indemnification

You agree to indemnify, defend, and hold harmless Make Your Home Glow, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of a third party
• Any claim that your photographs or enhanced images infringe upon or violate any third-party rights
• Any disputes with booking platforms, guests, or other third parties related to your listings

5. Dispute Resolution

Binding Arbitration: Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved exclusively through binding arbitration administered in accordance with the rules of the American Arbitration Association. The arbitration shall be conducted in Cheyenne, Wyoming, USA.

Class Action Waiver: YOU AGREE THAT ANY CLAIMS MUST BE BROUGHT IN YOUR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION. You expressly waive any right to participate in a class action lawsuit or class-wide arbitration.

Governing Law: These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, without regard to its conflict of law principles.

6. AI Processing Rules

Our AI enhancement technology operates under strict guidelines to ensure ethical and accurate photo enhancement. Our AI processing:

DOES NOT:

• Add furniture, decor, or objects not in the original image
• Remove furniture, clutter, or any objects from images
• Alter room dimensions, layouts, or architectural features
• Change the time of day or weather conditions depicted
• Create composite images from multiple photographs
• Generate synthetic or AI-created imagery
• Digitally stage empty or unfurnished spaces
• Modify views from windows or outdoor scenery

DOES:

• Adjust brightness, contrast, and exposure
• Enhance color balance and saturation
• Improve sharpness and clarity
• Correct white balance issues
• Reduce noise and grain
• Apply consistent style treatments across photo sets
